The Difference Between a Collection Agency and a Debt Buyer — Why It Matters

When a debt leaves the original creditor, it typically passes through one of two types of entities: a collection agency working on commission, or a debt buyer who has purchased the account outright. The difference between these two is fundamental to your negotiation strategy — they have completely different cost structures, incentives, and settlement flexibility.

Collection Agencies: Working on Commission

A collection agency does not own your debt. They work on behalf of the original creditor (or a debt buyer) for a percentage of what they collect — typically 20–35%. Their settlement authority is limited by what the creditor has authorized. They cannot accept a settlement the creditor hasn’t pre-approved. When you negotiate with a collection agency, you are effectively negotiating with the creditor through an intermediary.

Debt Buyers: Owners With Full Authority

A debt buyer has purchased your account outright — they own it completely. They can settle for any amount they choose without consulting anyone else. Their cost basis (what they paid) is their floor, and everything above that is profit. This gives them complete flexibility to accept settlements that a collection agency on commission could never offer.

How to Tell the Difference

Your debt validation demand will reveal this: a collection agency will identify the original creditor as the current creditor. A debt buyer will identify themselves as the current creditor. The chain of assignment documentation will show the sale. Knowing which type you are dealing with calibrates your opening offer — collection agency settlements typically start higher than debt buyer settlements.

The Regulatory Difference

Both are subject to the FDCPA. But only debt buyers are subject to California’s Fair Debt Buying Practices Act — with its strict chain of title documentation requirements. If you are dealing with a debt buyer, CFDBPA compliance is an additional leverage point collection agencies don’t face.
