Once a debt buyer files a lawsuit and you file your answer, formal discovery opens. For self-represented defendants, discovery is a powerful tool for exposing the documentation weaknesses that make debt buyer cases vulnerable. Used correctly, formal requests produce evidence that either wins at trial or forces settlement on your terms.
Form Interrogatories
California’s Form Interrogatories can be served without court approval and require sworn written responses. In a debt collection case, supplement them with special interrogatories asking: identify every person with personal knowledge of your specific account; state the purchase price paid for your account; provide the complete chain of title from original creditor to current plaintiff. These questions expose whether the plaintiff can actually prove their case under oath before trial.
Request for Production
A Request for Production requires the plaintiff to produce: the original credit agreement, complete payment history, each assignment agreement in the chain of title, the bill of sale specifically listing your account, and the foundation affidavit. Many debt buyers cannot produce all of these. Production responses that exclude key documents are themselves evidence of the problems you’ve identified through the validation process — and can support a motion to exclude the deficient documents at trial.
Using Discovery Results
Discovery responses revealing gaps — missing original agreements, bulk sale references without account-specific documentation, affiants who lack firsthand knowledge — are the evidentiary foundation for a summary judgment motion or a powerful settlement demand. “Your discovery responses confirm that [specific document] cannot be produced, which creates a significant evidentiary challenge at trial” is a factual observation that motivates settlement.
