A judgment against you is not the end of the negotiation. Judgment creditors frequently accept lump-sum settlements substantially below the judgment amount — because a judgment that cannot be collected is worthless, and the cost of enforcement (bank levies, wage garnishment, property liens) consumes both time and money. If you have a judgment against you that you cannot pay in full, settlement at a discount is often available.
Why Judgment Creditors Settle Below Face Value
A $10,000 judgment against a defendant with limited income and exempt assets may be practically uncollectable. The judgment creditor must pay for writs of execution, sheriff fees, and potential opposition to exemption claims. Garnishment on a minimum-wage income produces small monthly amounts over an extended period. A lump-sum settlement of $2,500 — certain and immediate — may be more valuable to the creditor than years of garnishment that never reaches $10,000 in total. Judgment creditors know this, and many are willing to accept settlements of 20-40 cents on the dollar for judgments that appear difficult to enforce.
Assessing Your Enforcement Exposure
Before negotiating a judgment settlement, assess what the creditor can actually collect from you. Exempt assets — retirement accounts, exempt portions of wages, Social Security income — cannot be reached. If your income is primarily from exempt sources and you have no significant non-exempt assets, you may be effectively judgment-proof, giving you maximum leverage in any settlement negotiation. If you have non-exempt assets (home equity above the homestead exemption, non-retirement investment accounts, vehicles with equity above the exemption), the creditor has real collection options that affect your settlement position.
The Satisfaction of Judgment
When you settle a judgment, the creditor must file an Acknowledgment of Satisfaction of Judgment with the court and record it with the county recorder — this removes the judgment lien from your real property. Confirm in writing that the creditor will file the acknowledgment within a specified time (typically 15 days) after payment. Follow up to confirm it was filed.
