California Debt Settlement System | Justice Foundation
One of the most disorienting debt collection experiences is being contacted by multiple collectors about what appears to be the same account. This happens because original creditors assign accounts to multiple agencies simultaneously, debt buyers resell portfolios, and collection attempts continue while accounts change hands. Understanding why this happens and how to respond protects you from paying the wrong party.
Why Multiple Collectors Contact You
Several distinct scenarios produce multiple collector contacts on one account. First, simultaneous assignment: some original creditors assign accounts to multiple collection agencies at the same time, with only one actually authorized to settle but all authorized to contact you. Second, consecutive ownership: debt that has been sold multiple times may have a new owner whose purchase hasn’t been reflected in prior collectors’ records, causing the prior collector to continue contacting you. Third, sub-assignment: a debt buyer who purchased your account may sub-assign collection authority to an agency while retaining ownership — both the owner and the agency may contact you separately.
How to Sort Out Who Actually Owns the Account
Send debt validation letters to every collector contacting you about the same account — on the same day, by certified mail. Require each to provide: the name of the current creditor, the complete chain of title, and their specific authority to collect. The responses will either identify the current owner clearly or reveal conflicting claims that you can use to defend any subsequent lawsuit. Never pay any collector until you have confirmed they are the current authorized holder of the debt.
The Payment Risk
Paying the wrong party — a collector who is no longer authorized to accept payment — may not satisfy the debt. The actual current owner can still collect from you even if you paid a former holder or unauthorized collector in good faith. Get written confirmation of collection authority before paying anything. The Justice Foundation kit includes a multiple-collector investigation guide and the consolidated validation letter for simultaneous service on multiple collectors.
